Abstract

Penelitian ini bertujuan untuk menganalisis pelaksanaan eksekusi riil terhadap putusan pembagian harta bersama pasca perceraian dalam perspektif hukum Islam serta mengkaji pertimbangan hakim dalam Putusan Nomor 234/Pdt.G/2024/PA. Bbu. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Sumber data diperoleh dari bahan hukum primer berupa putusan pengadilan dan peraturan perundang-undangan, serta bahan hukum sekunder berupa literatur ilmiah yang relevan. Hasil penelitian menunjukkan bahwa pelaksanaan eksekusi riil merupakan bentuk penegakan hukum atas putusan yang telah berkekuatan hukum tetap, yang bertujuan untuk memberikan kepastian hukum dan keadilan bagi para pihak. Dalam perspektif hukum Islam, pembagian harta bersama sejalan dengan prinsip keadilan (‘adl) dan kemaslahatan (maslahah), sebagaimana tercermin dalam ketentuan Kompilasi Hukum Islam yang memberikan hak masing-masing pihak atas bagian yang seimbang. Pertimbangan hakim dalam putusan tersebut didasarkan pada aspek yuridis, sosiologis, dan filosofis. Pelaksanaan eksekusi riil harus dilakukan secara proporsional, adil, dan sesuai dengan ketentuan hukum yang berlaku guna menjaga keseimbangan antara kepastian hukum dan nilai keadilan.
